1. Subject and parties
KAMAS provides software for managing appointments of hairdressers, barbers, beauticians and nail artists. The contract for the beauty service is concluded directly between the customer and the chosen salon. KAMAS does not perform beauty treatments and is not a party to that contract.
2. Appointment booking conditions
- The booking is complete once the confirmation is displayed on screen and, where available, once the confirmation is sent by e-mail or SMS.
- The customer must provide accurate and complete data, in particular a valid phone number in international format, which is essential for reminders.
- Available slots reflect the salon's opening hours and the actual availability of professionals; the salon may automatically assign the available staff member.
- Customers are asked to arrive five minutes before the booked time. A delay of more than fifteen minutes may lead to a shortened or cancelled service, with the no-show policy applying.
- The salon may decline or reschedule a booking for organisational reasons, illness of the professional or force majeure, informing the customer promptly.
- Online booking is free of charge for the customer: no amount is collected by the platform at the time of booking.
3. Cancellations and changes
- Free cancellation or change is possible up to two hours before the appointment time (Europe/Zurich time zone), via the link contained in the confirmation or reminder e-mail or SMS.
- Within the two hours before the appointment, online cancellation is no longer available: the salon must be contacted by phone at the number shown in the confirmation.
- The salon may charge up to fifty per cent of the service value for late cancellations, where this policy was communicated at the time of booking.
- As these are services to be performed on a specific date, the distance-selling right of withdrawal under European consumer law does not apply to appointment bookings (Art. 16(l) of Directive 2011/83/EU).
4. No-show
A no-show is a failure to attend the appointment without notice. In the event of a no-show, the salon may charge up to one hundred per cent of the value of the booked service and may require prepayment for subsequent bookings. Repeated no-shows may result in suspension of online booking at that salon.
5. Prices and payment
Service prices are expressed in Swiss francs (CHF) and include value added tax where applicable. Payment for the service takes place directly at the salon: the platform collects no amount from the end customer at the time of booking. For salons, the platform subscription is invoiced according to the plan subscribed, with SMS exceeding the included allowance billed per use.
6. User obligations
- Use the platform lawfully and do not make fictitious or automated bookings.
- Keep your access credentials safe and enable two-factor authentication where required.
- Promptly inform the salon of any allergies, intolerances or medical conditions relevant to the requested treatment.
7. Disclaimer and limitation of liability
KAMAS provides the platform with the utmost diligence but does not guarantee uninterrupted availability, absence of errors or delivery of every single SMS or e-mail, which depends on third-party operators. To the extent permitted by Swiss law, KAMAS excludes liability for indirect damages, loss of profit, loss of data or failure to perform an appointment; liability for intent and gross negligence, for injury to life, body and health, and any mandatory liability under Swiss law or European consumer law remains unaffected.
Liability for performing the beauty treatment, for the products used and for any skin reactions lies exclusively with the salon providing the service. Information published on the salon page (prices, durations, descriptions) is provided by the salon, which is responsible for it.
8. Intellectual property
The KAMAS brand, software, design and platform content are protected by copyright. Content uploaded by the salon (logo, images, descriptions) remains the property of the salon, which grants KAMAS a limited licence solely to display it on its public page.
9. Data protection
The processing of personal data is described in the Privacy Policy, which forms an integral part of these terms. The use of cookies is described in the Cookie Policy.
10. Changes to the terms
KAMAS may amend these terms with effect for the future. Material changes are communicated to registered salons at least thirty days in advance; continued use of the service constitutes acceptance.
11. Governing law and jurisdiction
These terms are governed by Swiss substantive law, excluding its conflict-of-law rules and the Vienna Convention on Contracts for the International Sale of Goods. The exclusive place of jurisdiction is Zurich, Switzerland.
Mandatory statutory jurisdictions remain reserved: consumers resident in the European Union or the European Economic Area retain the protection of the mandatory provisions of their country of residence and may bring proceedings before the courts of their domicile.
12. Digital acceptance of the contractual documents
When registering, the Salon digitally accepts, in a single declaration, these Terms & Conditions, the Privacy Policy and Annex A — Data Processing Addendum, which together form one contractual body.
The acceptance is recorded electronically together with the version of the Terms, the version of Annex A, the date and time and the professional account that accepted them. No paper or PDF signature is required.
Annex A — Data Processing Addendum (1/3): subject matter, nature, duration and data
- Subject matter: the processing by KAMAS, as processor, of the Salon's end-customer data for the sole purpose of providing the booking platform and its related functions.
- Nature and purpose: collection, recording, storage, consultation, sending of confirmations and reminders, anonymisation and deletion in line with the applicable retention limits.
- Duration: for the whole term of the Salon's subscription and, for residual data, up to the retention limits described in the Privacy Policy (maximum twenty-four months for personal data in bookings).
- Categories of data: the data strictly necessary to manage bookings and the related appointments (name, phone, e-mail, selected service, professional, date and time, organisational notes).
- Categories of data subjects: end customers booking with the Salon; the Salon owner and its staff.
- Salon instructions: KAMAS processes the data solely on the Salon's documented instructions, as set out in the Terms, in this Annex and in the configurable functions of the platform. KAMAS does not use customer data for its own commercial, marketing, advertising, profiling or CRM purposes.
Annex A — Data Processing Addendum (2/3): confidentiality, security, rights and breaches
- Confidentiality: authorised KAMAS personnel are bound by confidentiality and access a salon's data only for maintenance, security and support, strictly to the extent necessary.
- Security: multi-tenant isolation at database level (Row Level Security), authentication, available two-factor authentication, encryption in transit, password management through Supabase Auth with hashing, logging of security events.
- Assistance with data subject rights: platform functions allow the Salon to view, correct and delete the data of a booking or a customer profile; KAMAS provides the necessary technical support upon reasonable request.
- Data breach: KAMAS informs the Salon without undue delay after becoming aware of a breach affecting data processed on its behalf, sharing the available information relevant to the Salon's own assessments and notifications.
- Deletion and anonymisation: at the end of the relationship or upon expiry of the retention limits, personal data in bookings is anonymised or deleted by the platform's automated process, except for data required by accounting or legal obligations.
Annex A — Data Processing Addendum (3/3): sub-processors, transfers and audits
- Authorised sub-processors: Supabase (production database hosting on AWS infrastructure, EU region), Twilio (SMS delivery), Stripe (subscriptions and payments), Resend (transactional e-mails).
- KAMAS imposes on its sub-processors data protection obligations substantially equivalent to those of this Annex and informs the Salon of material changes; a Salon objecting on substantiated data protection grounds may terminate the subscription.
- International transfers: the production database is hosted in the European Union; some sub-processors may process data in third countries, relying on the safeguard mechanisms provided by applicable law and on the terms agreed with the provider.
- Reasonable audits: the Salon may request, on reasonable notice and as a rule no more than once a year, the available information and documentation needed to verify compliance with this Annex. Audits must not compromise the security, confidentiality or continuity of the service for other salons.
